Registering for the West Virginia Medical MJ Program

West Virginia patients must get a Patient Certification from an approved WV medical mj doctor as the first step when applying for a WV medical card. With a complete Patient Certification, patients can create an account with the West Virginia Office of Medical MJ Portal and begin the registration process. Most importantly, patients should keep note of the following basic requirements:

  • Only residents of West Virginia are eligible to join the WV medical mj program.
  • Patients must be eighteen (18) years or older to qualify.
  • Patients under eighteen (minors) may qualify if their parent or legal guardian registers as a caregiver, then applies on their behalf.
  • A patient must be suffering from at least one of the WV medical mj 2021 list of conditions.
  • Patients must mail the non-refundable $50 application fee via check or money order to complete their application.

A Brief History of West Virginia (WV) Medical MJ Program 

West Virginia legalized medical mj for certain conditions when Governor Justice signed Senate Bill 386 into law; on 19th April 2017. Four years down the line and the law has undergone amendments in 2018 and 2019 to include more qualifying conditions and bolster the medical mj program.

On the 3rd of February 2021, WV established the Office of Medical MJ. As a result, residents could join the WV medical mj program through an online application process. 29th January 2021 saw West Virginia’s budding mj program blossom when 100 dispensary permits were issued. However, despite these developments, medical mj is still not available in WV since no licensed dispensary is operational.

West Virginia Medical MJ Laws

The WV medical mj card grants patients access to medical mj in the state besides protecting them from arrest or prosecution when in possession of medical mj. However, the card doesn’t exempt patients from following West Virginia mj laws. Patients should be aware of the following West Virginia mj laws:

  • Approved patients CAN’T possess more than the 30-day supply of medical mj specified by their recommending physician.
  • Patients can only lawfully obtain medical mj from approved West Virginia mj dispensaries. Additionally, West Virginia mj laws strictly prohibit personal sales and, patients should avoid them.
  • West Virginia mj law doesn’t find mj paraphernalia, for instance, bongs and rolling paper, strictly necessary for medical mj treatment. So, patients have no legal excuse for possessing them or using them to create their own medicine.
  • Patients with a WV medical mj card CAN’T cultivate mj for personal use.
